Effective Strategies to Investigate and Prosecute Labor Trafficking in the U.S.

This five-part, online training series is designed to enable police and prosecutors to proactively identify victims of human trafficking and effectively investigate and prosecute labor traffickers using a victim-centered and trauma-informed approach. The overall objectives of this training are to identify labor trafficking and the modes, means, and methods with which offenders recruit and control victims; investigate labor trafficking through targeted, data-driven operations, as well as in response to identified red flags, victim disclosures, and tips from allied partners; implement trauma-informed practices to support victims, encourage participation, and conduct effective interviews; and hold offenders accountable by employing offender-focused prosecution strategies and leveraging multiple avenues to justice.

IACP and OVC, in collaboration with ICF, hosted a webinar called Untangling Survivor Engagement: Promoting Comprehensive Collaboration. Effective collaboration with experts who have lived experience contributes to a sustainable community-wide response to human trafficking. The discussion will focus on how survivors can help in navigating tough conversations, as well as creating space for shared learning across multidisciplinary teams.

IACP and OVC, in collaboration with NW3C, hosted a webinar for ECM human trafficking task forces to discuss an overview of the training, resources, and technical assistance provided by the National White Collar Crime Center (NW3C). Understanding the training and resources available for Enhanced Collaborative Model (ECM) Human Trafficking Task Forces is a critical component for success. NW3C provides a unique offering of training options, tools, and templates that can be utilized by law enforcement, regulatory agencies, and other criminal justice professionals investigating and responding to human trafficking. NW3C’s trainings and resources can assist law enforcement in human trafficking investigations where there are intersections with cybercrime and financial crimes. Since many human trafficking cases involve these components, developing this knowledge will help law enforcement build successful cases using digital evidence.

IACP and OVC, in collaboration with AEquitas, hosted a webinar called Maximizing Justice: Building a Prosecution Review Process. Justice can be measured and achieved in a variety of ways. In human trafficking cases, there are a number of avenues to justice—and it is paramount to consider both a victim’s perception of justice and law enforcement’s objective to maximize offender accountability. Determining the most effective route to justice requires knowledge of each avenue and the unique statutes, policies, and procedures that shape them.

IACP and OVC, in collaboration with ICF, hosted a webinar for ECM human trafficking task forces to discuss the Development and Operations Roadmap for Multidisciplinary Anti-human Trafficking Task Forces(“the Roadmap”). Published in May of 2020, The Roadmap combines principles on the stages of group development with assessment metrics that are designed to assist interdisciplinary groups with achieving and assessing collaborative impact as teams. Attendees will gain better knowledge on how to classify four distinct areas of work in which task force efforts are grounded; describe the process of task force development through five stages; communicate two practical ways in which they can use the Roadmap in their jurisdiction; and  identify two ways that conducting a task force self-assessment using the Roadmap can identify gaps and/or develop strategies for improving the collaborative functioning of a task force.

This webinar provided attendees with key insights to combat common defenses by educating judges and jurors about the realities of human trafficking; identify, build capacity, and collaborate with experts in your jurisdiction; and consult with experts to enhance investigations and prosecutions, even if experts aren't utilized at trial.

Specifically, the webinar discusses protective orders, courthouse safety measures, and strategies for bringing the voice of survivors into the courtroom through the doctrine of forfeiture by wrongdoing and other rules of evidence.

IACP and BJA, in collaboration with AEquitas, and the Rebecca Bender Association, hosted a webinar for ECM human trafficking task forces to discuss crimes that commonly accompany human trafficking activity and provide a framework to aid in decision-making when charging those offenses. The presenters will suggest strategies for analyzing the culpability of victims who have engaged in criminal activity and appropriate considerations for making decisions regarding charging and sentencing.

This course explained the role of a criminal intelligence analyst, the benefits of a working relationship with an investigator and why including an analyst as a part of your team is critical to your case development. The course discussed mock scenarios to demonstrate various situations in which an analytical partnership can enhance the outcome of an investigation.

AEquitas and IACP hosted a webinar for law enforcement. The presentation identified common dynamics in sex and labor trafficking and described how drugs and alcohol are used to assert and maintain control over their victims and perpetrate trafficking and trafficking related crimes. The presenter discussed the importance of and strategies for collaborating with service providers and medical professionals to identify drug-facilitated human trafficking, provide much needed care, and educate other allied professionals about the effects of drug use in the context of trafficking dynamics.
